X. Dispute Resolution

  1. The supervising vice president or senior officer designated by the President shall attempt to resolve any claim, dispute or controversy involving the rights to Intellectual Property. Upon the failure of the involved parties to reach a negotiated agreement, the supervising vice president or senior officer designated by the President may facilitate a resolution by referring the matter for mediation or arbitration. Mediated agreements shall be binding upon all affected parties only when reduced to writing and signed by all the parties.
  2. Should the parties not reach an agreement, then any party to the dispute may appeal in writing to the Intellectual Property Review Board. Individuals appealing the decision must do so within five working days. Upon appeal, the Board shall review all documents and records and hear testimony from all interested parties, such as the principal investigator, students involved with the research, representatives from partnering organizations, etc. Board findings shall be made in the form of recommendations to the Executive Vice President of Academic Affairs. The decision of the Executive Vice President of Academic Affairs shall be final.
